Wishlist Pro Terms and Data Processing Addendum

These terms are between NICCOS GmbH, Freiburg im Breisgau, Germany (NICCOS) and the Shopify merchant installing Wishlist Pro (Merchant). Installing or using the app confirms acceptance by an authorized representative.
Service
Wishlist Pro provides storefront wishlists, optional notifications and integrations, reporting, and purchase attribution. The Merchant must operate a Shopify store, follow Shopify’s terms, provide lawful customer notices, and use the service only for lawful purposes.
Plans and billing
Free, Growth, and Pro limits and prices shown in Shopify and in the app apply. Paid plans are billed only through Shopify Billing in USD. Paid plans include a seven-day trial. Merchants can upgrade, downgrade, or cancel in the app. Shopify handles charges, currency conversion, taxes, and refunds under its billing rules.
Data-processing instructions
For personal data submitted by or collected for the Merchant, the Merchant is controller and NICCOS is processor. NICCOS will process that data only to provide, secure, support, and legally operate Wishlist Pro; keep personnel subject to confidentiality; maintain appropriate technical and organizational measures; assist with data-subject requests and incidents; delete or return data as required; and make compliance information available on reasonable request.
Subprocessors
The Merchant authorizes Shopify, Heroku/Salesforce, and Resend as subprocessors, and Klaviyo when the Merchant enables that integration. NICCOS remains responsible for processor obligations delegated to subprocessors and will use appropriate data-protection terms. Material subprocessor changes will be communicated through this page or the app.
International transfers
Where required, NICCOS and its subprocessors rely on applicable adequacy decisions, standard contractual clauses, or other lawful safeguards for international data transfers.
Security and incidents
NICCOS applies the controls described in the Privacy Policy, including encryption, access limitation, logging, backups, data minimization, retention automation, and incident response. NICCOS will notify affected Merchants without undue delay after confirming a personal-data breach and provide information reasonably needed for their obligations.
Availability and liability
The service is provided with reasonable care but may be interrupted for maintenance, provider outages, or events beyond NICCOS’s control. Liability is limited to the extent permitted by applicable law; mandatory liability remains unaffected.
Termination
The Merchant may uninstall at any time. Shopify’s redaction workflow triggers deletion of shop data. Provisions that by nature survive termination, including payment, confidentiality, data protection, and liability provisions, remain effective.
